The services rendered by bureau BrevetMarcService are the following:

- conducting search through the registered appellations of origins, geographical indications;

- registration of the  appellations of origins and geographical indicationswith the Patent Office of the Republic of Moldova

- obtaining (applying for) the right of utilization in respect of the registered appellations of origins and geographical indications for 10 years period and further renewals;

- assistance in entry of amendments in applications, in necessary technical conditions (specifications) of goods  covered by the registered appellation of origins or geographical indications and preparation of other relevant legal documents;

- overall tracking of the procedural deadlines;

- administrative and judicial protection of the interests of the holders of the intellectual property objects, including filing the Request for prohibition of the right of utilization of the registered appellations of origin and geographical indicationswith the Chamber of Appeals.

1. Requirements for the appellationsof origin and geographical indicationsapplication,including the necessary documents.

Information and documents, which are necessary at the time of filing of the application:

a) the applicant’s full name, domicile and address.

b) list of goods, as well as theirtechnical conditions (specifications) of goods, approved by the competent authority.

с) unified document, which includes basic elements of technical specifications (title of the  appellation of origin / geographical indication, a description of goods and its characteristics, a brief description of the boundaries of the geographic area) as well as the description of the links between goods and geographical environments or geographical origin.

d) group’scharter

e) confirmation from the local authorities that the applicant has already  carried out their production activities in respect of the claimed goods in the designated geographical area

f) evidence of utilization of the appellations of origin and geographical indications.

d) for the geographical areas outside Moldova  – confirmation of the registration of the appellations of origin or geographical indications in the country of origin.

Information and documents must be filed within two months of the filing of the application with the Patent Office:

Formal examination – 3 months following the date of filing.

The opposition term – 3 months following the.

The substantive examination - 6 months following the publication date.

Issuing of the Official Action of registration – 1 month following the examination.

Payment of the official fee for the registration and issuing of the Certificate – 3 month following the date of issuing of the Official Action.

Granting the Certificate  - 30 days +1 month following the registration date, provided the payment of the official fee.

4. Duration of the procedure.

The period from filing till issuance of the Certificate is approximately 15 months.  unless there are filed any claims, demands, refusals, etc.
